Public Announcement regarding Assembly Action on the Recall Petition

***PUBLIC ANNOUNCEMENT as of April 25, 2012***


On April 24, 2012, at the regular meeting of the Borough Assembly, the following motion was made:

13a PROPOSED RESOLUTION: A RESOLUTION OF THE ASSEMBLY OF THE CITY AND BOROUGH OF WRANGELL, ALASKA, DIRECTING THE BOROUGH CLERK TO SCHEDULE A SPECIAL ELECTION ON JUNE 12, 2012 ON THE QUESTION OF WHETHER TO RECALL JIM NELSON, LURINE MCGEE, SYLVIA ETTEFAGH, MARK ROBINSON, LINDA BJORGE, JAKE HARRIS, DELORES NORMAN AND LEANN RINEHART FROM THE OFFICE OF BOARD MEMBERS OF THE WRANGELL MEDICAL CENTER

Moved by Privett, seconded by Jack, to adopt resolution.

Moved by McConachie, seconded by McCloskey, to modify motion to delay decisions on this resolution until we have an answer from financing from the USDA on Wednesday.

Amendment to main motion failed with Jack, Privett, and Maxand voting no; McCloskey and McConachie voting yes.

Main motion passed with Jack, Privett, and Mayor Maxand voting yes and McConachie and McCloskey voting no.

Upon roll call vote, there were three affirmative votes for the motion, and two nay votes.

The Borough Clerk recorded the vote as 3-2 and stated that the motion passed.

On April 25, 2012, the Borough Clerk and the Borough Manager reviewed Wrangell Borough Code 1.12.070(E), which states: “An affirmative vote of four members of the assembly is required for adoption of a resolution.”

The Borough Clerk and Borough Manager, after consultation with the Borough Attorney, agree that the motion was inaccurately recorded as having passed. In accordance with WBC 1.12.070(E), the motion failed.

The minutes of the meeting for April 24, 2012, will correctly record the motion as having failed. The minutes for the April 24, 2012 meeting will be presented to the Assembly for review at the next regular meeting.
